DUI versus DUAC
In South Carolina, there are two offenses related to impaired driving charges: Driving Under the Influence (DUI) and Driving with an Unlawful Alcohol Concentration (DUAC). DUI is charged when an individual has been accused of impaired driving. DUAC is only charged when an individual has submitted to a Breathalyzer test, regardless of evidence related to impairment.
